By using Gili.com website or making a purchase with Gili.com you should be deemed to have accepted these terms and conditions listed below or as may be revised from time to time, which is, for an indefinite period and that you understand and agree that you are bound by such terms whenever you access this website. Your agreement to these terms and conditions be legal binding contract between you and Gili.com, binding on both.

We reserve the rights to change these terms and conditions from time to time without any obligation to inform you and it is your responsibility to look through them as often as possible.

Payment

In the event we received payment by credit card, you agree that you will not seek to chargeback or recover your payment or any other losses from Gili.com. Further, you agree that, for the purposes of any applicable credit card scheme rules, by completing your booking and remitting payment to the relevant Service Provider(s), Gili.com has discharged in full its responsibilities to you. By accepting these Terms and Conditions you hereby waive the right to seek any chargeback against Gili.com with respect to any such payment and you agree that these Terms and Conditions may be used by Gili.com to resist any chargeback you seek to make against Gili.com

All products/services and information displayed on Gili.com constitute an invitation to offer. Your order for purchase constitutes your offer which shall be subject to acceptance and the terms and conditions as listed herein. eGitanjali Ltd., reserves the right to accept or reject your offer. Our acceptance shall be constituted by dispatch of the product(s)

In case you are a User from country other than India We encourage and advise you to discuss all purchases within your country before making a decision on purchase outside your country. Severability

If you make any submission to a Public Area or if you submit any business information, idea, concept or invention to Gili.com by email, you automatically grant-or warrant that the owner of such content or intellectual property has expressly granted Gili.com a royalty-free, perpetual, irrevocable, world-wide nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform, and display the communication or content in any media or medium, or any form, format, or forum now known or hereafter developed. ] Gili.com may sublicense its rights through multiple tiers of sublicenses. If you wish to keep any business information, ideas, concepts or inventions private or proprietary, do not submit them to the Public Areas or to Gili.com by email. We try to answer every email in a timely manner, but are not always able are bound to do so. 7. Impersonating another person;
8. Distributing viruses or other harmful computer code;
9. Harvesting or otherwise collecting information about others, including email addresses, without their identification for posting or viewing comments; consent;
10. Allowing any other person or entity to use your identification for posting or viewing comments.

Gili.com reserves the right (but is not obliged) to do any or all of the following:

5. Monitor, edit, or disclose any communication in the Public Areas.
6. Edit or delete any communication(s) posted on the Gili.com Site, regardless of whether such communication(s) violate these standards. Gili.com or its licensors have no liability or responsibility to users of the Gili.com Site or any other person or entity for performance or nonperformance of the aforementioned activities


Cancellation and Refund Policy

>> Products and services once booked through Gili.com cannot be cancelled and the refunds thereof are not allowed in any circumstances. However, exceptional cases of 'manufacturing defect' and ' wrong consignment ' can be dealt with separately after due verification of proof and based on established facts with vendor partners on case to case basis.

Cancellation of transactions by the End-User/ Customer can be due to any of the following reasons:

The order may be cancelled before shipment due to any of the following reasons:

1. The specific product/model is out of Stock
2. The order could not be shipped within the specified timeline.
3. The shipping address is not serviceable
4. Any other force majeure reason beyond the control of vendors or Gili.com, including bandh, strike, natural climatic, etc.

The orders may be cancelled post shipment and delivery due to any of the following reasons:

1. Established defect in the product which the seller is not able to either replace or repair, within the warranty timelines.
2. Correct product could not be delivered after first replacement
3. Shipping address found to be untraceable, wrong, incomplete, locked and customer not available.
4. Products lost, damaged during transit and delivery not accepted


Conditions:

A. The refund shall be processed only after the product is shipped back unused and received by us in its original condition with the original packing without any tampering.
B. User needs to attach original invoice and relevant documents as provided with the product to process refunds.
C. The return courier awb /tracking number should be communicated to Gili.com customer support.


Refund Policy:

1. Once the above are established gili.com will credit user’s payment account.
2. Gili.com will deduct amount of refund from the vendor’s settlement account.

We request for such returns within 7 days from delivery of the product to your shipping address. We shall process the refund subject to receipt of the merchandise by us in unused condition in its original packaging along with original tags and invoice, failing which return/ refund may not be possible.

Before accepting delivery of the product/s, please ensure that the packaging has not been damaged or tampered with. If you believe that the merchandise is not in good condition, or if the packaging is tampered with or damaged, before accepting delivery of the goods, please refuse to take delivery of the package, and call our all-day helpdesk at 022-40102200/01 or e-mail us at ecommerce@gitanjaligroup.com, mentioning your order reference number. We shall make our best efforts to ensure that a replacement delivery is made to you at the earliest. In the event you return any item which is delivered to you in damaged/defective condition, there will be no additional shipping charges.

After the merchandise is received by www.Gili.com, and subject to verification of the purchase and condition of products we shall process a refund within 10 business / working days of receipt of the product/s.

Refunds of payments charged to the Cardholder's debit /credit card will only be credited back to the Cardholder's debit / credit card account, which was used to pay for the original order. Please note that we shall not be responsible for any delays in credit to the Cardholder's debit / credit card account as that is managed by the Cardholder's issuing bank.

We shall not allow any exchange/return of products due to the price differential that exists, as no two similar products will be exactly of the same price. All items must be returned in their original condition as unworn, unaltered, and undamaged. Items returned without an attached brand/ security tag will be subject to 15% revaluation fee.

Governing Law

THIS AGREEMENT SHALL BE DEEMED TO BE MADE UNDER, AND IN ALL RESPECTS SHALL BE INTERPRETED, CONSTRUED AND GOVERNED BY AND IN ACCORDANCE WITH, THE COURTS OF MUMBAI, THE LAW of INDIA, WITHOUT REGARD TO ANY CONFLICT OF LAW PRINCIPLES THAT WOULD CAUSE THE LAWS OF ANY OTHER JURISDICTION TO APPLY.

Each party hereby irrevocably submits to the jurisdiction of the courts of Mumbai, State of Maharashtra and Country of India and hereby waive, and agree not to assert, as a defense in any such action, suit or proceeding for the interpretation or enforcement hereof, that it is not subject thereto or that such action, suit or proceeding may not be brought or is not maintainable in said courts or that the venue thereof may not be appropriate or that these Terms and Conditions or any such document may not be enforced in or by such courts, and the parties hereto irrevocably agree that all claims with respect to such action or proceeding shall be heard and determined in appropriate Mumbai Courts. The parties hereby consent to and grant any such court jurisdiction over the person of such parties and over the such subject matter and agree that mailing of process or other papers in connection with any such action or proceeding in such other manner as may be permitted by law shall be valid and sufficient service thereof.

Shipping Duration

 

 Delivery time is based on your location pin code (within 4-5 business days after order confirmation) i.e. in areas where standard courier service is available.


Disclaimer:

The details of the products or product specifications (for instance weight, color, handwork details, size, etc.) quoted with the product displays are only fairly approximate values. While every endeavor has been made to accurately reproduce colors, there may be minor variations in color of the actual product because of the nature of product, weather at the time of differences in display output due to lighting and digital photography and color settings and capabilities of monitors. A customer must place an order keeping in mind this minor variation in color as seen on a computer screen against the actual color of the product received. Gili.com believes that all online buyers are aware that colors seen on a monitor will be slightly different as compared to the actual product or accessories ordered.
